Terms and Conditions
Welcome to our Online Store. These Terms and Conditions govern your use of this website and the purchase of any grocery goods from us. By placing an order, you agree to be legally bound by these terms.
1. Australian Consumer Law (ACL) Compliance
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). You are
entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
2. Pricing, GST, and Weight Variations
Goods and Services Tax (GST): All prices listed on our website are in Australian Dollars (AUD) and are inclusive of GST where applicable. Basic, unprocessed grocery items are generally GST-free under Australian tax law.
Weight Variation: Many of our traditional fresh fruits, vegetables, or butcher cuts are subject to natural weight variances. The final price calculated at packing will closely match the weight ordered, but minor reasonable variations up to 10% are accepted as standard industry tolerance.
3. Bio-Security, Imports, and Product Authenticity
We source authentic subcontinental, Indian, and South Asian brands. All imported food products strictly comply with the requirements managed by the Department of Agriculture, Fisheries and Forestry (DAFF) and are checked for biosecurity safety upon entering Australia. Packaging designs or ingredient language translations may vary from domestic products but remain fully compliant with Australian food standards.
4. Delivery, Click & Collect, and Perishable Goods
Delivery Windows: We will endeavor to deliver within your selected Bacola theme delivery slots. However, times are estimates and subject to regional courier delays.
Perishable Logistics: For cold chain or temperature-sensitive goods (such as paneer, fresh dairy, sweets, frozen parathas, or fresh vegetables), the customer must ensure a person is physically present at the delivery location to accept the order. We accept no liability for spoilage if goods are left unattended at your doorstep under ‘Authority to
Leave’ (ATL).
5. Food Standards Australia New Zealand (FSANZ) & Allergen Disclosure
Product specifications, nutritional panels, and allergen warnings (such as nuts, gluten, or dairy cross-contamination warnings) are printed on the product packaging by the
manufacturer in accordance with FSANZ guidelines. Customers with severe food allergies must review ingredients carefully before consumption. Our store acts as a retailer and assumes no liability for inaccurate third-party manufacturer product labeling.
6. Returns, Cancellations, and Refunds
Perishable Goods: Due to health and safety regulations, claims regarding fresh produce, dairy, or frozen items must be reported within 24 hours of receipt alongside
visual photographic evidence.
Change of Mind: Under the ACL, we are not legally required to provide a refund or replacement if you simply change your mind about a grocery purchase.
Refund Processing: Valid refunds will be processed back via the original payment pathway (e.g., credit card or local Australian bank transfer via secure payment gateways) within 3-5 business days.
7. Governing Law
These terms and conditions are governed by the laws operating in the State/Territory of your business registration in Australia, and any legal disputes will remain under the exclusive jurisdiction of the courts of that specific state.
